1. Acceptance of Terms
By accessing or using the APEX Hospitality Staging Portal, client cabinet viewports, or custom visual inspection staging frames (collectively, the "Platform"), you agree to be bound by these Terms of Service ("Terms") and all applicable international laws. If you do not agree to these Terms, you are prohibited from accessing or using the Platform.
2. Platform Scope and Commissioned Workspaces
APEX Hospitality provides custom, high-fidelity software prototypes, staging environments, and digital engineering installations ("Commissioned Workspaces") for private client preview. Access to specific workspaces is restricted to authorized clients and administrators.
You are solely responsible for ensuring the confidentiality of your login credentials. Any activity logged under your authenticated Firebase identity is deemed to have been authorized by you.
3. Prohibited Usage & Security Boundaries
You agree not to bypass, disable, or tamper with the Platform's security features, including the simulation bypass systems, developer access overrides, role-mapping filters, or write-once security logs. Unauthorized attempts to access developer panels, modify other clients' staging paths, or extract private code metadata will result in immediate termination of access.
4. System Verification and Activity Logs
For compliance, security verification, and platform integrity, the Platform records a permanent security ledger. This includes tracking user logins, staging revisions, deletion requests, IP addresses, browser User Agents, and persistent device signatures. By using the Platform, you acknowledge and consent to this continuous monitoring.
5. Intellectual Property
All custom components, 3D post-processing effects, canvas staging annotation HUDs, custom shaders, templates, database configurations, and compiled code files rendered on this Platform are the exclusive property of APEX Hospitality and its technology licensors, protected by global copyright and patent laws.
6. Limitation of Liability
IN NO EVENT SHALL APEX HOSPITALITY, ITS DIRECTORS, OR ITS TECHNOLOGY PARTNERS BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, OR CONSEQUENTIAL DAMAGES ARISING OUT OF THE USE OR INABILITY TO USE THE PLATFORM, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGE. THE WORKSPACES ARE PROTOTYPES PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND.
7. Governing Jurisdiction
These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law principles. Any dispute arising under these Terms shall be resolved exclusively in the state or federal courts located in Wilmington, Delaware.
